RULE: 2.39 - SUBSTITUTION OF CONTAINER/EQUIPMENT SIZE
Effective 1/20/16
When, at time of booking, a Shipper or his Agent requests that a particular size transporting
container or equipment be made available for Shipper to load, and due to operational exigencies,
Carrier is unable to provide or obtain such size container or equipment, Carrier at its option and
convenience may, when available, furnish Shipper with a different container or equipment size than
the one requested for Shipper's use, SBJ to the following provisions and restrictions.
a. Ocean freight and charges will be calculated and assessed based on the size of the container or
equipment requested and booked by the Shipper, PROVIDED, the Shipper does NOT load more cargo into or
onto the container or equipment actually furnished than could have been loaded within or on the
container or equipment requested.
b. When cargo is tendered to the Carrier, Shipper must furnish a complete packing list and/or a
Shipper completed B/L showing the actual weight and cubic measurements of all cargo loaded into or
onto the container or equipment furnished to the Shipper.
c. Carrier reserves the right to weigh, measure and/or inspect the cargo loaded into or onto the
container or equipment prior to the commencement of transportation service. If Shipper or his Agent
loads a quantity of cargo in excess of the amount that can be loaded into or onto the originally
requested container or equipment size, ocean freight and changes will be assessed based on the rates
published for the size of the container or equipment actually furnished by the Carrier, instead of
the size of the container or equipment requested.
d. Carrier's B/L and/or Invoice will be claused substantially as follows to insure the proper
application of Tariff rate and provisions per this Rule:
"CARRIER SUBSTITUTED EQUIPMENT - _____ (here specify type and size of equipment originally
requested) ORIGINALLY REQUESTED"
e. Carrier may make the following substitutions under this Rule:

NOTE A: Both containers must be from a single Shipper to a single Consignee and must move on a single
